Terms of service
In short
Elias Immersive LLC runs this service: 3D tours of real places with an AI concierge that answers visitors’ questions, and the tools businesses use to set them up. If you run tours here, you own your content and you’re responsible for it. If you’re visiting a tour, the concierge is an AI and can be wrong, so check anything important with the property directly. Use the service lawfully and don’t try to break it. These terms work together with our privacy policy.
Who these terms apply to
These terms are an agreement between you and Elias Immersive LLC (“Elias Immersive”, “we”, “us”). They cover everyone who uses the service:
- Operators — businesses with a workspace, and the teammates they invite, who set up and manage properties and tours.
- Client-portal users — people an operator invites to see their own properties’ tours and results, and, when the operator allows it, to run those tours themselves.
- Visitors — anyone who opens a tour, chats or talks with the concierge, or sends a tour’s contact form.
- Property contacts — people who answer an operator’s questionnaire about a property.
If you use the service for a business, you accept these terms on its behalf and confirm you’re allowed to. If your business has a separate signed agreement with us, that agreement wins where the two differ. The service isn’t meant for children under 13, and you must be at least 18 to hold an account.
The service
Elias Immersive hosts branded tour pages built on Matterport digital twins; an AI concierge that answers from each property’s own information, by text and, where the operator turns it on, by voice; an optional contact form; embeds for operators’ own websites; client portals; and the admin workspace behind them. The service is young and changes often. We may add, change, or remove features, and when we can, we’ll give operators reasonable notice before removing something they rely on.
Accounts
Accounts are by invitation, or by a request that we approve. Give accurate information, keep your sign-in secure, and don’t share your account; you’re responsible for what happens under it. Workspace admins decide who joins their workspace and what each person can do, and can remove people at any time. If you think someone has got into your account, tell us right away at judson@eliasimmersive.com.
Your content
Operators keep ownership of what they put into the service: property details and facts, uploaded documents, questionnaire and interview answers, imported website text, branding, and links to Matterport models (“your content”). You give us permission to store, copy, process, and display your content only as needed to run the service for you — for example, to show it on your tours, to let the concierge answer from it, and to send it to the AI providers named in our privacy policy. We don’t claim ownership of your content, and we don’t use it to train commercial AI models.
You’re responsible for your content. You confirm you have the rights and permissions it needs — including from the property’s owner and from anyone whose photos, documents, or words you upload — and that it doesn’t break the law or anyone else’s rights. Keep it accurate and current: the concierge answers from it.
The AI concierge
The concierge is an AI, not a person, in chat and on voice calls. It answers from the information the property’s operator has provided, and its answers can still be incomplete, out of date, or wrong. So:
- Confirm anything that matters — prices, availability, capacity, dates, policies, accessibility — with the property directly before you rely on it.
- Nothing the concierge says is an offer, a quote, a reservation, or a promise by the property or by us. Bookings and agreements happen with the property itself.
- It doesn’t give professional advice, such as legal, financial, medical, or safety advice.
Voice calls end after 10 minutes. How we handle what you type or say is described in our privacy policy.
Contact forms and leads
When a visitor sends a tour’s contact form, we pass it to that property’s team and to any tools its operator has connected, such as a CRM. From then on, the operator is responsible for how the lead is used, including following anti-spam and privacy laws. We handle visitors’ data on the operator’s behalf, and operators agree to act on a visitor’s request to see or delete their data (workspace settings has the tools for it).
Agencies and client portals
An operator can give its own clients access through a client portal under the operator’s brand. The operator is responsible for those clients’ use of the service, and for giving them terms that protect Elias Immersive at least as well as these do.
Matterport and other services we rely on
Tours display 3D models hosted by Matterport, and Matterport’s own terms apply to them. An operator that connects its own Matterport account is responsible for that account. We never copy scan content into our own systems; scans live in Matterport, either in your account or, if you transfer a copy to us, in ours (see below). The service also depends on providers such as Anthropic, OpenAI, ElevenLabs, Clerk, Resend, Cloudflare, Neon, and Vercel; our privacy policy says what each one receives. An outage or change at one of them can affect the service. We aren’t responsible for services we don’t run, including websites the concierge links to and tools an operator connects.
Scans you transfer to us
If you don’t have your own Matterport developer license, you can transfer a copy of a Matterport space to our Matterport account so your tour can use the service’s 3D features. When you do:
- You keep ownership of the space and everything in it. Transferring it gives us only a limited right to host that copy in our Matterport account and show it through the service, for your own tours, while you use the service.
- We don’t sell it, share it with anyone else, use it for any other property or customer, or use it to train AI models.
- Send a copy, not your original: a transferred space leaves your Matterport account. Matterport’s own terms apply to it while it’s in ours.
- You confirm you have the right to transfer it — for example, that the property’s owner agreed to it being scanned and shown online.
- When you ask, or when your account closes, we transfer it back to you or delete it from our Matterport account, as you prefer, within 30 days.
Acceptable use
Don’t use the service to:
- break the law, infringe anyone’s rights, or publish content that is deceptive, defamatory, hateful, or sexually explicit;
- upload malware, or anything you don’t have the right to share;
- get into accounts, workspaces, or data that aren’t yours;
- probe, scan, or test the service for vulnerabilities without our written permission (reports are welcome — see below);
- overload or scrape the service, get around rate limits or usage caps, or access it by automated means other than features we provide for that;
- push the concierge into producing harmful content, ignoring its instructions, or revealing its instructions or anyone else’s information;
- send spam or fake contact-form submissions, or harass anyone, including a property’s staff;
- copy the service, or use it or its output to build a competing product or to train AI models;
- resell or sublicense access, except as your agreement with us allows.
We may remove content or limit access that breaks these rules.
Usage limits and fees
Some features have limits, such as voice minutes per plan and a daily cap on AI usage; when a limit is reached, that feature pauses until it resets. Fees, if any, are set in a written order or agreement between an operator and us, and are paid as agreed, plus any applicable taxes. We never charge visitors.
Privacy
Our privacy policy explains what we collect, where it’s stored, how long we keep it, and how to ask for a copy or deletion. For data about visitors to an operator’s tours, we act on that operator’s behalf.
Suspension and closing a workspace
You can stop using the service at any time, and an operator can ask us to close its workspace by emailing us. We may suspend or end anyone’s access if they break these terms, put the service, other users, or visitors at risk, or if the law requires it. When it’s reasonable, we’ll tell you first and give you a chance to fix the problem.
When a workspace is closed, its data is deleted as our privacy policy describes. If you want a copy of your content, ask us before the workspace is closed. The parts of these terms that by their nature should continue — such as responsibility for content, disclaimers, limits on liability, and indemnity — continue after access ends.
Our rights
The service — its software, design, and the Elias Immersive name and logo — belongs to us and our licensors. These terms let you use the service as described here, and nothing more. If you send us ideas or feedback, we may use them without owing you anything.
Disclaimers
To the extent the law allows, the service is provided “as is” and “as available”. We don’t promise that it will be uninterrupted, error-free, or secure against every threat, or that AI answers will be accurate or complete, and we disclaim implied warranties such as merchantability, fitness for a particular purpose, and non-infringement.
Limits on liability
To the extent the law allows, neither Elias Immersive nor its suppliers will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from the service or these terms. Our total liability for all claims is limited to the greater of what you paid us for the service in the 12 months before the claim and US $100. Some places don’t allow these limits, so they may not all apply to you.
Indemnity
Operators will defend Elias Immersive against third-party claims, and cover the resulting losses and reasonable costs, where the claim arises from their content, their use of leads, their client-portal users, or their breach of these terms.
Reporting a problem
Report a security issue, content you believe infringes your rights, or misuse of a tour to judson@eliasimmersive.com, with the page address and what you saw. For security issues, don’t access more data than you need to show the problem, and give us reasonable time to fix it before telling anyone else.
Changes to these terms
We may update these terms as the service changes. When we do, we change the “last updated” date at the top of this page and, for material changes, tell operators by email. Using the service after a change means you accept the updated terms.
